Risk, Ownership & Insurance
Risk in the hire goods will pass immediately to the customer when they leave the physical control or possession of the company [Equiport] and it will remain with the customer until the hire goods are back in the physical possession of the company.
Ownership of the hire goods remains at all times with the company. The trailers will be covered on the insurance of the towing vehicle against damage.
It is the customer’s responsibility to ensure that they have adequate insurance cover and driving licence before renting any horsebox from Equiport. You should contact your insurance company to advise them that you will be towing a double axle horsebox. Please contact the Department of Transport for new regulations regarding trailer towing. www.transport.ie
In the event of total loss i.e. theft or written-off damage, the customer will be charged the full retail price of a new trailer. It will be the customer’s responsibility to seek reimbursement from their insurers for the cost of new trailer.
In taking delivery of the trailer the customer must satisfy him/herself that the equipment is in all respects roadworthy and in proper and safe condition. If you feel that this is not the case, the customer should bring this to the attention of Equiport immediately.
Breakdown
Allowance will be made in relation to the rental to the customer for any non- use of the Horsebox due to breakdown caused by the development of an inherent fault and/or wear and tear on condition that the Customer informs Equiport as soon as practicable of the breakdown.
The customer shall be responsible for all expenses, loss (including loss of rental) and/or damage suffered by Equiport arising from any breakdown of the horsebox due to the customer's negligence or misuse of the trailer.
Liability
The customer agrees to indemnify and keep indemnified Equiport against any and all losses, damages and claims suffered by Equiport arising from or due to any breach of contract or any negligence/misuse on behalf of the customer. The customer shall check that they have suitable insurance that will cover third party damage and personal liabilities. No liability will rest with any member or Equiprt if an animal suffers injury during loading/unloading & transportation. Responsibility lies with the customer to ensure that their animal is equiped with all the relevant travel protection while being transported. All animals are transported at owner's risk. It is assumed that owners have checked their Insurance Policies to ensure they are covered to use animal transporters.
Cleaning & Repairs
Before rent, each horsebox is cleaned and maintained to our schedule and should be returned in a reasonably clean condition. All damages to our trailers while in the possession of the Customer must be reported immediately to Equiport. The cost of repair for all damages sustained to the trailer while in the possession of the Customer shall become the sole responsibility of the Customer. Under no circumstance shall any third party be engaged, or act on behalf of the Customer for the purpose of repairs unless specifically authorized in writing by Equiport.
If the equipment is returned damaged the Customer agrees to pay Equiport the reasonable cost to repair the damage. Repair of the equipment will not commence until the Customer pays Equiport the estimated cost of such repairs. Summary
- The customer takes full responsibility for the horsebox during the rental period
- The customer must be covered by his/her own car insurance while towing a horsebox.
- The horsebox must only be used for carrying goods for which it is intended. ie a horse/pony
- Any damage to the trailer must be paid for by the customer
- The trailer must be secured with the supplied locking device AT ALL TIMES whilst not being towed
- The customer is responsible for observing towing regulations, laws and weight limits of the horsebox they are using in conjunction with their tow vehicle.
- The customer must inform Equiport of any damage on the return of the horsebox.
- The customer must have suitable insurance that will cover third party damage and personal liabilities
